By accessing this Website, browsing our products, or placing an order with us, you agree to be bound by these Terms and Conditions (“Terms“). Please read them carefully before using the Website or placing an order. If you do not accept these Terms, please discontinue use of the Website and do not place an order.
We may update these Terms from time to time. The current version, with its “Last updated” date, is always available on this page. Any update takes effect when posted; your continued use of the Website or placement of an order after an update constitutes your acceptance of the revised Terms.
1. About us and the products
1.1 The Website is operated by AEIOU INTERNATIONAL SDN. BHD. (Registration No. 1319543-X).
1.2 We provide customised business printing products and services, including but not limited to business cards, marketing materials, packaging and stickers, and other printed goods (“Products“).
1.3 All Products are customised to some degree and are manufactured to the specifications, artwork and finishing options you select. Because of this customisation, Products generally have no resale value, which is the basis of the refund and return provisions set out in Clause 5 and our Refund & Return Policy.
2. Orders, acceptance and specifications
2.1 All orders are subject to availability and to our acceptance. An order is accepted only when we confirm it unconditionally (an “Order Confirmation“). An automated acknowledgement from the Website is not acceptance.
2.2 We reserve the right to reject any order at our sole discretion without stating a reason, including where the content or artwork is, in our opinion, unlawful, harmful, threatening, defamatory, pornographic, discriminatory, profane, offensive, or otherwise breaches third-party rights or is contrary to public policy.
2.3 We continuously develop our products and may amend specifications without prior notice. Minor differences may arise as a result of the different colour systems used on-screen versus in print.
2.4 We may cancel orders placed at an incorrect or outdated price.
3. Your artwork, design and submissions
3.1 You may supply your own artwork (by upload or other means) or create a design using our online BCMY Designer tool, which is based on our pre-designed templates.
3.2 Intellectual property — three layers.
- 3.2.1 The BCMY designer software, design templates, and any designs we create ourselves are owned by BusinessCard.my and are protected by copyright and other intellectual-property laws. You may not copy, extract, reverse-engineer, sub-licence or reuse our templates or software outside the Website.
- 3.2.2 Any artwork, design or content you supply (whether uploaded, emailed, sent by WhatsApp, or added by you within the designer) remains your property (or that of your licensor). You confirm that you own or control all rights to that content and that it does not infringe any third-party rights. You grant us a limited, non-exclusive licence to reproduce, print and store that content solely for the purpose of producing, delivering and supporting your order.
- 3.2.3 Where you create a finished design in the BCMY Designer using our templates, the resulting design incorporates our templates. You acquire a licence to use the finished design for the Product you purchase and for your own business use. This does not transfer ownership of our templates, which remain ours.
3.3 While we are always happy to help, you remain responsible for the accuracy, lawfulness and quality of the content you supply. Without limiting Clause 8, we are not responsible for errors contained in artwork you supply, including spelling, punctuation, typos, contact details, logos or low-resolution images.
3.4 We will not use your supplied artwork or personal content for marketing outside the order without your prior written consent. (Please see our Privacy Policy.)
4. Price, payment and currencies
4.1 All prices are expressed in Malaysian Ringgit (RM) and, where applicable, are inclusive of the goods and services tax or sales and service tax payable. The price you see at checkout is the total price for your order.
4.2 Payment must be made in full at the time of ordering and before production begins. We accept the payment methods shown at checkout and on the Website, which include credit/debit card (via our payment gateway), DuitNow (Touch ‘n Go eWallet, GrabPay, Boost, MAE) and bank transfer.
4.3 You are responsible for any applicable taxes, duties or charges imposed in the destination territory (outside Malaysia) to which Products are shipped.
4.4 Production begins only once we have received full payment and, where applicable, your approval of the artwork preview (see Clause 6).
5. No refund / no return (customised products)
5.1 Because our Products are customised to your specifications and have no resale value, we do not accept returns or provide refunds for:
- change of mind;
- incorrect product type, size, material, finishing or quantity selected by you;
- design preferences or colour choices;
- errors in artwork, content or files you supply or approve (including spelling, contact details, logos, or low-resolution images);
- event-date changes; or
- orders cancelled once production has begun.
5.2 An order may no longer be cancelled or refunded after any of the following has occurred:
- (a) the artwork/design preview has been approved;
- (b) the confirmed artwork has been passed to our prepress / CTP team and placed into a gang-run slot on the CTP plate (colour separation and plate preparation), even if the offset machine has not yet printed. This is why our lead time is counted from the next working day — once the artwork is committed to the plate, the job cannot be pulled or changed;
- (c) printing, cutting, finishing or personalisation has started;
- (d) custom materials have been ordered for your order; or
- (e) the order has been transferred to our external production supplier.
5.3 Nothing in these Terms or our no-refund policy excludes or limits any right or remedy you have under the Consumer Protection Act 1999 that cannot lawfully be excluded. Where a genuine defect on our part is established, you are entitled to a remedy as set out in Clause 7 and our Refund & Return Policy.
5.4 This is the basis of our Refund & Return Policy, which we display clearly before you confirm your order.
6. Artwork preview / digital proof — approval is binding
6.1 Where we provide an artwork preview or digital proof (including via the BCMY Designer and/or WhatsApp), you must review all content, layout, page order, quantity, size and specifications before approving.
6.2 Approval authorises production. Once you approve the artwork preview — which you do by confirming your design in the BCMY Designer and/or by replying to our confirmation message and making payment — that approval is recorded (with a time-stamp) and is binding.
6.3 Where we do not issue a separate proof, the provision of print-ready artwork (or the completion of your design in the BCMY Designer) may be treated as your approval to print that file.
6.4 We are not liable for errors that appeared in the approved preview or supplied artwork and were not corrected before approval. Any change or cancellation requested after approval may not be possible and may incur additional charges or require a new quotation.
7. Claims for genuine defects and remedies
7.1 If you believe the Product is defective or does not meet the confirmed specifications, please contact us by email or WhatsApp within seven (7) working days of receiving your order, quoting your order number and providing photographs or videos of the issue and the packaging.
7.2 If we do not hear from you within seven (7) working days, we will treat the Product as delivered to your satisfaction and, except as required by law, will have no obligation to provide a remedy.
7.3 We require up to two (2) working days to assess a claim, and may request further information. Where we confirm a genuine defect on our part, the remedy will be, in our discretion and in line with our Refund & Return Policy: reprint (no additional charge), replacement, or a partial refund for the affected quantity only. We are responsible for the re-delivery cost where the Product was materially different from your order or defective.
7.4 Do not return Products without our prior written authorisation.
8. Colour, tolerances and quality
8.1 Colour. On-screen (RGB) colours will differ from printed (CMYK) colours. Monitor calibration, viewing environment and browser settings all affect how a colour appears on your screen. We cannot guarantee an exact match between the colour on your monitor and the printed Product. We use a CMYK offset/digital process; a reasonable colour deviation (up to ±10% against our printed CMYK reference) is accepted as normal production variation and is not a defect.
8.2 Tolerances. Printing, cutting and finishing are subject to manufacturing tolerances, which are accepted as normal production variation and are not defects:
- Colour: ±10% (vs. our printed CMYK reference)
- Card trimming: ±1 mm
- Spot UV: ±0.5 mm
- Finishing position (embossing, debossing, die-cut, foil stamping): ±1–2 mm, depending on the production method used.
For most finishing effects (emboss, deboss, die-cut, foil stamping) we use one of two production methods:
- Standard / semi-custom (the more cost-effective option, and the one most customers choose): the card is trimmed to standard size first, then the finishing effect is applied. Because of the combined trimming and finishing tolerances, the position of the effect may vary by ±1–2 mm.
- Custom-run (maximum accuracy): the finishing effect is applied before trimming, giving a tighter tolerance. This is higher in cost (and may be several times more expensive for smaller quantities).
The applicable production method and tolerance for a specific product are stated on the product page and/or confirmed with you by WhatsApp before production. You may choose the method where we offer a choice. Where an order-specific document or our confirmation states a specific tolerance or method, that takes priority over this general clause (see Clause 15.3).
8.3 Images. Please provide high-resolution, print-ready images. Low-resolution images, web images or unauthorised third-party content may print blurred or pixelated and will not be treated as a defect.
8.4 We do not provide a colour-match guarantee without a hard-copy proof approved by you in writing.
9. Delivery
9.1 Local delivery (Malaysia). Estimated delivery is one (1) to five (5) working days depending on the material, design and delivery location. Working days are Monday to Friday, excluding public holidays.
- Peninsular Malaysia: free delivery on orders above RM75.
- Sabah & Sarawak: delivery is calculated on the basis of weight and is shown at checkout.
- Separate delivery fees apply for each additional delivery destination.
9.2 International shipping. Please contact us for details.
9.3 You are responsible for providing a correct and complete delivery address. We are not responsible for additional costs to retrieve or reprint items returned due to an incorrect address or failed delivery.
9.4 Delivery On-Time or Free Business Card programme and Next Day Delivery, where offered, are subject to the terms displayed with those offers (selected materials; cut-off 5:00 p.m. Mon–Fri excluding weekends and public holidays; working-day ETA).
9.5 Delivery time is not of the essence of the contract. We are not liable for delay caused by events beyond our reasonable control (see Clause 14) or by the courier, nor for any loss or expense you incur as a result.
10. File submission and customer-supplied content
Without limiting Clause 3.3 and Clause 8, we are not responsible for print quality issues caused by:
- spelling, punctuation or grammatical errors in content you supplied or approved;
- low-resolution or inferior-quality images;
- design or colour-selection errors in your artwork file;
- errors in your selected options (product type, size, finishing, quantity);
- incorrect dimensions, orientation or file formatting vs. our specifications;
- delivery delays caused by improperly prepared files; or
- duplicate orders.
11. Copyright warranty and indemnity
11.1 You warrant that any content you upload or supply (including images, text, logos and designs) is either your work, is owned by you, or you have the right to use it, and that it does not infringe any third-party copyright, trade mark, design, privacy or other right.
11.2 You agree to indemnify and hold us harmless against loss, costs, expenses and damages (including reasonable legal costs) arising from claims that your content infringes any third-party rights or is unlawful.
11.3 You acknowledge that we may, at our discretion, refuse or remove content that we reasonably consider infringing or unlawful.
12. Limitation of liability
12.1 Subject to any rights that cannot lawfully be excluded under the Consumer Protection Act 1999:
- we are not liable for any indirect, incidental, consequential or special loss or damage;
- we are not liable for loss of profits, business, revenue, goodwill, opportunity or economic loss;
- we are not liable for loss or damage arising from errors in customer-supplied or customer-approved artwork, low-resolution files, or your choices of product, material, finishing or colour; and
- our total liability to you in respect of any order is limited to the amount you paid for that order.
13. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms or your use of the Website is subject to the exclusive jurisdiction of the courts of Malaysia.
14. Force majeure
We are not liable for delay or failure to perform where caused by events beyond our reasonable control, including (but not limited to) supplier delays, printing-machine breakdown, courier delay, power failure, internet disruption, natural events, strikes, or changes in law. Where such an event affects an order, we will inform you and, if unused Products cannot realistically be delivered, you will be entitled (where we recover a refund or equivalent) to a refund of the amount attributable to that order, as set out in our Refund & Return Policy.
15. General
15.1 If any provision of these Terms is found to be unlawful or unenforceable, it will be severed and the remainder will continue in force.
15.2 These Terms (together with our Refund & Return Policy, Privacy Policy and Disclaimer) form the entire agreement between you and us in relation to the Website and your orders.
15.3 Any quote, approved proof, order confirmation or policy that is specific to an order forms part of the agreement. Where an order-specific document conflicts with these general Terms, the order-specific document takes priority.
15.4 These Terms do not limit any right or remedy that cannot lawfully be excluded under Malaysian law.
