The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice any or all Agreements: "Buyer", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "businesscard.my", "Seller", "Ourselves", "We" and "Us" refers to the owner of the website who registered office is 25A, Jalan SS21/60, Damansara Utama, 47400 Petaling Jaya, Selangor, Malaysia. "Party", "Parties" or "Us", refers to both the Client and ourselves, or either the Client or ourselves. "Goods" refers to goods to be supplied to the Buyer by businesscard.my.
2. Basic of Sale
These Terms and Conditions shall apply to sales of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered or relied on by the Buyer whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless the Buyer specifically states in writing, separately from such terms, that it wishes such terms to apply and this has been acknowledged by the Seller in writing.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
3. Orders and Specifications
All Goods are subject to the Seller's acceptance of the Order. The Seller reserves the right to reject any Order without the obligation to assign any reason for doing so. The Seller has a policy of continuous product development and reserves the right to amend the specifications of any of the Goods.
Goods supplied may therefore differ as a consequences of multi-standard colour systems, notably the international screen based colour system of RGB and the print colour system of CMYK. The Seller endeavours to display and describe as accurately as possible the printed colours of the Goods, but cannot undertake to give any assurance that the colours of Goods supplied will exactly match.
For every 100pcs Order, there will be a plus and minus of 3% of the quantity. 99% of the Order will have additional.
4. Response Email Time
Wherever possible we will endeavour to respond to emails within 24 hours of receipt (excluding weekends and Public Holidays). The email service will be checked for emails between the hours of 9.00am-6.00pm Monday to Friday.
5. Price, Payment and Currencies
The Buyer shall be responsible for all applicable taxes, including taxes for the territory to which the Goods are sent. Payment must be made by bank transfer at the time of placing an Order. Payment in full will be taken at this time and the Contract will be enforce. The Buyer undertakes that all details provided to the Seller for the purpose of the Order and its delivery will be correct. The Seller reserves the right to obtain validation of the Buyer account number and personal details before accepting the Buyer's Order.
The place for delivery of the Goods will be as shown on the Order. The Seller will endeavour to process the Order and manufacture the Goods within the time period stated for each item. However, due to manufacturing time varies by item of Goods, the Seller reserves the right to combine items into one shipping package or to ship items separately. Each package will be sent separately by regularly post, unless otherwise stated in the Order Confirmation.
Any dates quoted for delivery of the Goods are estimate only. Time for delivery will not be of the essence of the Contract and the Seller will not be liable for any loss or expenses sustained by the Buyer arising from any delay in the delivery of the Goods however caused. The fastest delivery date is the next working day. (Terms and Conditions applied.) Most of the business cards, estimated time is 3 - 5 working days, while custom made business card requires about 8 - 10 working days.
The Buyer must inspect the Goods on delivery and, in case where Goods have been delivered by carrier, sign the required proof of delivery document or collection acceptance document.
A signature on that document will constitute conclusive evidence against the Buyer of receipt the quantity of Goods indicated on the document free from any apparent defect or damage. If the Goods are alleged to be damaged or defective on delivery, a description of the alleged damage or defect must be given in writing at the time of delivery and signed by or on behalf of the Buyer.
If the Buyer wrongfully fails to take the delivery of Goods, the Seller shall under no obligation to refund the Price. Goods may not be returned to the Seller except as provided in Section 7 below.
7. Risk and Property
Notwithstanding delivery and the passing risk in the Goods, production of the Goods will not start production until the Seller had received full payment of the Price and all other sums.
8. Returns, Refunds and Right of Cancellation
The buyer shall have the right to cancel any Order for Goods only in the following circumstances:
• If the Seller has failed to deliver the Goods ordered within 30 days after the artwork confirmation by the Buyer.
Please note that our printing services do not provide any return and refund system policy for any customer.
9. Limitation of Liability
The Seller will not be liable for short delivery of defective Goods unless Buyer has discovered the fault or defect after delivery and in no longer than 3 days after receipt. The notification must include the Order confirmation number, delivery number and details of the claim.
The Seller might can replace the Goods or refund the Buyer the Price, all decision can be sole discretion. The Seller will not be liable in any way for loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing. Other than that, they are also not liable in any circumstances outside the reasonable control of the Seller, including (but not limited to), any strikes, industrial action, failure of power supplies or equipment, government action or Act of God.
Buyer should take fully precautions to ensure that whatever computer equipment and/or software selected for use is free of such items as viruses, worms, Trojan horses and other items of destructive nature. Seller will not be liable in the damage of particular computer equipment.
10. Intellectual Property
a) businesscard.my website is fully owned and operated by the Seller. Seller owns the copyright with respect to all content such as text, graphic, logos, audio clips, trademarks, software server information, and anything else hosted on this website. All rights to content, services, and server information are reserved. Any modification made by third party is a violation of Seller's copyright. Additionally, other proprietary notices and copyright information on the website must be observed and followed.
b) Nothing contained on the website should be constructed as granting, by implication, estoppels, or otherwise, any license or right to use the website or any information displayed on the website, through the use of framing or otherwise.
c) The businesscard,my logo, name, and other marks indicated on the website are the subject of the application for registered trademarks of the Seller in Malaysia. Seller maintains all the rights in the graphics, logos, page headers, button icons, scripts and services names. All the content mentions on above are the trademarks or trade dress of businesscard.my Trademarks and trade dress may not be used in connection with any product or service other than the Seller's.
d) Buyer shall not use the service offered by the Seller to infringe the intellectual property rights of others in any way, including any images, fonts or other that are uploaded by Buyer to the Seller's online service. Buyer will be solely and fully responsible for any claims or any losses arising out of Buyers of any such rights. Sellers reserves the right, with or without notice, to terminate forth with the account of any Buyer who infringes the copyrights or other intellectual property rights.
11. Data Protection
